Last updated: September 30, 2026

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of encryptconsulting.com and any related pages, forms, and tools we operate (together, the "Site"). The Site is operated by Encrypt Consulting ("we," "us," or "our"). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. What We Offer

Encrypt Consulting provides software development, business development, and technology consulting for startups, small businesses, and entrepreneurs in the United States and Latin America. The Site describes our work and lets you contact us or request information. Descriptions on the Site are not a binding offer; any engagement begins only when both parties agree in writing.

Information on this website is general and is not legal, financial, tax, investment, or security advice. Free strategy sessions are informational and create no obligation on either side. Paid engagements are governed by a separate written agreement or statement of work, which controls if it conflicts with these Terms.

3. Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

We may block access, remove content, and pursue any remedy available to us if we believe you have violated this section.

4. Intellectual Property

The Site and everything on it, including text, graphics, logos, images, layout, design, and code, is owned by or licensed to Encrypt Consulting and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your own personal or internal business use. No other rights are granted, and all rights not expressly granted are reserved. The names and logos of Encrypt Consulting are our marks and may not be used without our written permission.

5. Information You Send Us

When you submit a form, send us an email, or book a call, you agree to give us accurate information. You grant us permission to use what you send to respond to you, evaluate your request, and provide our services, as described in our Privacy Policy. Please do not send passwords, payment card numbers, government ID numbers, health information, or other sensitive data through the Site's forms.

6. Third-Party Links and Services

The Site may link to or rely on third-party services (for example, scheduling and hosting providers). We do not control and are not responsible for third-party sites or services, and your use of them is governed by their own terms and policies.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that its content is complete or current.

8. Limitation of Liability

To the fullest extent permitted by law, Encrypt Consulting and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Encrypt Consulting and its owners, officers, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

10. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including Acceptable Use, Intellectual Property, disclaimers, limitation of liability, and governing law) will survive.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. You agree that any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Your continued use of the Site after a change means you accept the updated Terms.
